Terms of Use

The agreement for using Bimiq, and the line we draw: the tool assists your review, it does not sign off your drawings.

These terms are the agreement between you and Bimiq for using our website, web application and Bridge. The part worth reading twice is where we draw the line on professional judgement: Bimiq reviews your documents and proposes findings, but it does not replace the judgement and sign-off of a licensed architect or engineer.

01This agreement

These Terms of Use govern your access to and use of the Bimiq website at getbimiq.com, the Bimiq web application, and the Bimiq Bridge desktop application, together the service. By creating an account or using the service, you agree to these terms. If you are agreeing on behalf of a firm, you confirm you have the authority to bind that firm.

If you do not agree with these terms, do not use the service. Your use of the service is also subject to our Privacy Policy and Cookie Policy.

02Your account

You need an account to use the product. You are responsible for keeping your sign-in secure, for activity under your account, and for making sure the details you give us are accurate. Tell us promptly if you believe your account has been used without your permission.

The service is for construction and design professionals and is not intended for anyone under 18. An organisation account may have several seats; the organisation is responsible for the people it invites and for their use of the service.

03Trial, plans and seats

The free trial gives you a set period and a fixed allowance of credits without a card. When the trial ends, continued use of the metered features requires a paid plan. Plans are sold per seat, and the credit allowance is pooled across the seats in your organisation.

We may change the trial length and allowance for new sign-ups. Any change to what your current plan includes is covered by "Changes to the service and these terms" below.

04Credits and metered use

Credits are the unit we meter AI work in. Only the actions that run a model over your documents consume credits; uploading, viewing results, and most of the product are free. Each metered action is charged at the rate shown at the time, and some actions scale with the size of the work, such as the number of drawing sheets in a set.

  • Included credits refresh at the start of each billing cycle and do not roll over.
  • Credits you buy as a top-up are not tied to the cycle and remain until used.
  • When your balance is exhausted, metered actions are blocked until you top up or the cycle renews. Nothing you have already produced is taken away.
  • Credits have no cash value, are not transferable, and are not refundable except where these terms or the law require it.

05Billing and payment

Paid plans are billed in advance, monthly or annually, through our payment provider. By subscribing, you authorise us to charge the plan fee and any usage charges that apply. Fees are exclusive of taxes, which are added where required.

You can change or cancel your plan from your organisation billing settings. Upgrades take effect immediately, with the new allowance available straight away. Downgrades and cancellations take effect at the end of the current billing cycle, and fees already paid for the current cycle are not refunded except where the law requires it.

06Your content

You keep all rights in the documents you upload and in everything Bimiq derives from them. We claim no ownership of your project content.

You grant us the limited licence we need to operate the service: to store, process and display your content back to you, and to send it to our AI provider to produce your results. As stated in our Privacy Policy, your project content is never used to train a public AI model.

You are responsible for having the right to upload what you upload, and for not uploading content that infringes someone else's rights or that you are not permitted to share.

07Acceptable use

You agree not to:

  • Use the service unlawfully, or to infringe the rights of others.
  • Attempt to break, probe or circumvent the security of the service, or access accounts or data that are not yours.
  • Reverse engineer, resell, or build a competing product from the service, except to the extent the law does not allow that restriction.
  • Interfere with the service's operation, or place an unreasonable load on it through automated means.
  • Upload malware, or content that is unlawful or that you have no right to share.

We may suspend or close an account that breaches these terms, where necessary to protect the service, other users, or ourselves.

08Bimiq is assistive, not a substitute for professional judgement

Bimiq is a tool that assists review. It does not replace the professional judgement, sign-off or duty of care of a licensed architect, engineer or other qualified professional.

Bimiq's findings, verdicts and answers are proposals to be checked, not decisions. Every finding is presented so you can verify it against the source, and you should. The service can miss real issues and can raise findings that are not issues, particularly where a drawing is faint, rotated or poorly scanned.

Bimiq does not issue drawings, submit RFIs, or change your model on its own. It drafts and proposes, and you decide and execute. You remain responsible for the documents you issue and the decisions you make, and you must not rely on the service as the sole basis for a decision that requires professional judgement.

09Connected services and the Bridge

If you connect a document source or run the Bridge, your use of those connections is also subject to the terms of the third parties involved, such as the terms of your Autodesk, Microsoft or Procore accounts. You are responsible for having the right to connect those accounts and import from them.

The Bridge runs on your own machine and reads the model you have open. As described on our security page, the model is not uploaded, and the Bridge acts only on the queries you run and the changes you execute.

10Our intellectual property

The service itself, including its software, design, and the Bimiq name and logo, belongs to us and our licensors. These terms give you a limited, non-exclusive, non-transferable right to use the service while your account is active. They do not give you any right in the service beyond that use.

11Availability and disclaimer

We work to keep the service available and accurate, but we provide it on an as is and as available basis. We do not warrant that the service will be uninterrupted, error-free, or that its output will be complete or correct.

To the fullest extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not exclude any warranty that cannot be excluded by law.

12Limitation of liability

To the fullest extent permitted by law, Bimiq is not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data, or the cost of rework, arising from your use of or inability to use the service.

Our total liability to you for any claim arising out of these terms or the service is limited to the amount you paid us for the service in the twelve months before the event giving rise to the claim.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

13Indemnity

You agree to indemnify Bimiq against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the service, or content you upload that infringes the rights of a third party.

14Suspension and termination

You can stop using the service and close your account at any time from your settings. We may suspend or end your access if you breach these terms, if required by law, or where necessary to protect the service or other users.

On termination, your right to use the service ends. The sections that by their nature should survive, including content ownership, disclaimers, limitation of liability, and indemnity, continue to apply. How we handle your data after termination is described in our Privacy Policy.

15Changes to the service and these terms

We keep building the product, so features may change, be added, or be removed. We may also update these terms as the product and the law change. When we make a material change to the terms, we will update the date at the top and, where appropriate, tell you in the product or by email. Continuing to use the service after a change means you accept the updated terms.

16Governing law and contact

These terms are governed by the law of the jurisdiction in which Bimiq is established, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, except where mandatory local law gives you a different right.
